The Website is hosted, developed and updated by Vanksen.

Vanksen has developed the Website in order to present the Viral Film Festival which it organizes.
The objective of the Website is to present the festival to all Web users, especially the objective of the festival, and the jury, to allow them to interact on this level, and to allow everyone to participate in the festival contest.
The objective of the conditions of use provided below by Vanksen is to ensure that every User can peacefully browse the Website, especially in respect of their rights.
1. Presentation of the Website
The objective of the Website is to present the realization of the Viral Film Festival organized by Vanksen to all Web users, and therefore:
- All the news relating to the festival or to viral videos in general are published on the Website.
- The Website allows every person to submit their video if they wish, and/or to sign up for the Viral Film Festival event.
- Videos submitted by the different participants are published on the Website.
- Users have the possibility to react to articles or videos that are published on the Website.
Every User can also follow the news of the Viral Film Festival by subscribing to the RSS feed and following the festival’s Twitter account and/or Facebook group through different available applications.
2. Intellectual Property
Any content, including, but not limited to, any logo, trademark, and photo on the Website is protected under intellectual property rights, or under any other legal provision applicable under the circumstances.
Vanksen is the holder of all the rights in connection with this content, unless a third party is expressly designated as the holder.
In this context the Website presents the logos of partners and sponsors who are associated with the Viral Film Festival event, especially through their logos.
Any reproduction, distribution, or adaptation of the entire content or of part of the content on the Website is prohibited without prior permission by Vanksen and as the case may be the holder.
Vanksen respects the intellectual property rights of third parties, and all legal provisions in force concerning information publication. It consequently takes all measures at its disposal in order to ensure that the content on the Website does not infringe protected rights.
Every User who publishes a comment on the Website is solely responsible for the content of their comment. Consequently every User must respect all the rules in force and may not publish any statement that violates third parties’ rights, that is violent, slanderous, or racist, that discloses personal data of third parties, etc.
As the means at Vanksen’s disposal in this framework are limited, Vanksen invites everyone to contact the publication director in order to inform him about any content which in their opinion violates intellectual property rights or does not respect the rules in force.
If Vanksen receives any demand of this kind it will take the measures it deems necessary concerning the transmitted information and will inform the concerned person about it.
Concerning the post-moderation Vanksen reserves the right to delete any comment that does not respect regulations in force, at any time, following a simple decision by Vanksen.
Any User who detects comment content that does not respect the legal dispositions can inform the publication director who will take the measures he deems necessary concerning the information in his possession.
3. Privacy protection charter
The communication of personal data is not a condition for accessing or for browsing the Website. In this framework no personal information will be collected without the Users’ knowledge, especially during their navigation on the Website.
The information which Vanksen can collect is the information which every User voluntarily provides under the following conditions.
- Contact form and comment publication: the collected and saved data are the name and email address, so that the User’s request can be sent and their comment be published if applicable; the data are saved for the duration which is necessary for realizing the objectives and for complying with the regulations in force concerning the publication of online content;
- Form to participate in the festival: the conditions of use of the collected data are specified in the festival rules;
- Form to sign up for the event: Users can sign up for the event on the platform Amiando (www.amiando.com). The Users are asked to enter their last name, first name, company, and email address. It is specified that the data collected through this form will be transmitted to Vanksen and its event organization partner if applicable in order to ensure the proper organisation of the event. Furthermore, these data will be saved in order to transmit news about upcoming Viral Film Festival events to the participants.
In accordance with the amended law of August 2, 2002 on the protection of persons concerning the treatment of personal data Vanksen collects and saves these data only for the abovementioned purposes in order to ensure the compliance with its obligations as a hosting provider. In this framework Vanksen can be forced to disclose any content in order to comply with the laws in force, especially in the framework of a lawsuit, in order to react to actions and/or claims, especially ones arguing the infringement of third parties’ rights.
Vanksen engages not to use the collected data for any other use than for the abovementioned purposes, and especially to not use them for commercial purposes without prior authorization by the User in question.
Vanksen is the only donee of the collected data, unless stipulated otherwise below. Vanksen takes all precautions in order to ensure the safety of the Data. However, it cannot eliminate all the risks linked to the use of the Internet. Other Internet users might possibly be able to view the Data during their communication.
In accordance with the law Vanksen reserves the right to access, modify and oppose (in case of a legitimate motive) the treatment of the Data. Any User can exercise their rights by contacting Vanksen by email at pr@vanksengroup.com or by mail at Vanksen 7 ZA du Bourmicht, L-8070 Bertrange, Grand Duchy of Luxembourg in order to modify or delete the Data.
Confidentiality of information provided by underage persons
Vanksen is naturally concerned about the security of information provided by underage persons. The possibilities offered by the Website allow underage Users to submit personal information.
Please note that it is not Vanksen’s intention to spontaneously send emails to underage persons, i.e. without them having requested this. As Vanksen is unable to verify that the Users are of age, it invites all parents/guardians to contact the publication director in order to demand that the information provided by the children in their care be deleted.
4. Use of cookies
The Website contains cookies in order to collect and save information regarding the use of the Website. The cookies are designed to help Vanksen recognize every person who accesses the Website as a previous User of the Website in order to offer the most adapted service and to allow for browsing under the best possible conditions.
The cookies Vanksen uses cannot extract personal information from the User’s hard drive that would enable Vanksen to identify the User in another way than through cookies, and cannot transmit computer viruses.
To measure your interest in the different sections of our Website, we reserve the right to analyze the behavior of Users of the Website. All information that will be collected on this occasion will be used for the sole purpose of improving the Website’s content, for enhancing the Users’ pleasure when browsing the Website, and for customizing the content and/or page layout.
Every User can influence the cookies by changing their browser’s configuration. It is possible to accept all cookies, to be notified when activating a cookie, or to reject all cookies. Vanksen has no control over these other sites and cannot monitor or verify their contents. Unless expressly stipulated otherwise by Vanksen, the content of these websites cannot be associated with the Website and with Vanksen. It is up to the User to take note of the conditions of use of every website they visit and to verify the truthfulness of the communicated information.
Vanksen declines any liability regarding any link on an external website that directs to the Website. The Site cannot be associated with the website containing this link and its contents unless specifically authorized by Vanksen.
6. Liability
Vanksen carries out a regular update of its contents and devices installed on the Website to allow the User to access and use the Website under the best conditions. However, Vanksen cannot guarantee the timeliness, completeness, accuracy, and integrality of the content on the Website.
Vanksen recommends that the User verify the contents, notably through the contact data, prior to use. In any case Vanksen declines any liability regarding the User’s use of the content, this liability being limited according to the provisions stipulated in the article “Intellectual Property”.
The User is in this context fully aware that the content on the Website is indicative.
Vanksen reserves the right to change the Website at any time, and cannot guarantee that the User has access to the entire Website at any time, without interruption, timely, safely and without error.
It is specified that the changes may relate to the nature or extent of the available services. Vanksen invites the User to verify the contents by contacting the publication manager at the abovementioned address.
It is specified that Vanksen cannot be made liable for any inconvenience or damage caused to a User resulting from the actions of a third party which has used the information published on the Website through an unfair technical means. However, Vanksen assures that it will engage the means at its disposal to any fight such action, being limited by the constraints inherent to the Internet.
Vanksen is not liable for any possible damage to the information technology equipment caused through the use of the Website. The objective of this non-liability clause is not to evade applicable legal dispositions or to exclude liability in cases in which it cannot be excluded under the abovementioned dispositions.
